The Petition of Samuel Barton, Frances Barton, James Carroll and Nancy, his wife, Abraham Crabtree and wife Isabella, against William Barton

Respectfully represents to (Your) Honor, that the Petitioners and Def(endant) are the children and heirs under law of one John Barton, late of Orange County, who departed this life some time in the month of __ in this year of 1837, intestate--that at the time of his death, the said John was owned and possessed of a tract or parcel of land situated in the County of Orange,on the waters of New Hope, and known as the "Mallott Place," the same containing 104 acres or thereabouts -- that the said land hath descended to your petitioners as heirs at law of the said John Barton -- the Defendant William Barton, one of the sons of said John -- is now and hath for some years been resident beyond the limits of this State.
Your petitioners further show to your Honor that the land in question cannot by reason of it's quantity, and the number of persons among whom it is to be divided, be "actually" divided among them, without injury  to the shares of one or all of said persons and they therefore pray of your Honor, to grant to the petitioners a devise for the sale of said land by the motion of this Court, upon such terms and at such time and place, as to your Honor may seem just and or may the purposes of the parties hereto and __ is duty bound.

              In the name of God Amen
I Eleanor Barton of the County of Orange and State of North Carolina being of sound and perfect mind and memory do this 21st day of February in the year of our Lord 1857 make this my last will and testament in manner following that is to say First I give and bequeath to my daughter Fanny two beds and furniture Also one beaureau one loom and gear one cupboard one large pot and oven and two pot racks Also four setting chairs warping bars and spool frames one reel and two slays And I also bequeath to daughter Isable Crabtree fifty cents and I bequeath to my Son Stephen or his heirs if any fifty cents, Also I give to my son Samuel's heirs if any fifty cents and I also bequeath to my son William fifty cents and I give to my daughter Nancy fifty cents and I do hereby ordain John P. Faucett my Executor of this my last will and testament where of I the said Eleanor Barton do here set my hand and seal the day and date above written

James CARROLL

The James Carroll found on the 1830 Orange County census and the 1840 Orange County census is an old man, most likely the James Carroll who died in 1842.  His will, dated 8 March 1842 and proved in the May 1842 court, gives his wife's name as Polly.

The location of James and Nancy Barton Carroll in 1830 and 1840 is not known.
